The state, home to a staggering 32 of the world’s top 50 AI companies, is taking bold steps to ensure that the development of powerful AI technologies does not outpace safety measures. The California State Assembly has recently voted in favor of SB 53, a landmark bill aimed at preventing catastrophic risks associated with AI, particularly the potential for AI to contribute to nuclear weapons development.

Following the defeat of a federal moratorium on state-level AI regulation, California policymakers recognized a critical opportunity to shape the future of AI laws across the United States. SB 53 mandates that developers of “frontier” AI models—those that are highly advanced and require substantial data and computing power, like OpenAI’s ChatGPT and Google’s Gemini—must generate transparency reports detailing their safety protocols. Having passed both legislative chambers, the bill is now awaiting the signature of Governor Gavin Newsom.

Frontier AI systems represent the cutting edge of technology, capable of generating content and making decisions based on vast datasets. While these technologies promise immense benefits, they also pose significant risks. SB 53 is particularly concerned with “catastrophic risks,” which could include scenarios like AI-enabled attacks on biological systems or rogue AI conducting cyberattacks that disrupt critical infrastructure. These risks have the potential to inflict widespread harm on a global scale, raising alarms about the future of AI governance.

The bill defines catastrophic risk as a “foreseeable and material risk” that could result in over 50 casualties or more than $1 billion in damages, attributing a meaningful role to frontier AI models in such events. Determining fault, however, will be a complex matter for the courts, given the evolving nature of AI and its applications. Policymakers hope that by establishing a legal framework around catastrophic risks, they can better protect society from both immediate and long-term threats.

While a single state bill may not fully avert the potential dangers posed by advanced AI, SB 53 represents a proactive approach to regulating a rapidly developing technology. This legislation follows in the footsteps of previous attempts to address AI’s risks, including California’s SB 1047, which was vetoed by Newsom, and New York’s Responsible AI Safety and Education (RAISE) Act, which is currently awaiting the governor’s approval in that state.

Introduced by State Senator Scott Wiener, SB 53 requires AI companies to create safety frameworks specifically designed to mitigate catastrophic risks. Before deploying their models, these companies will be obligated to publish comprehensive safety and security reports. Additionally, the bill mandates that companies report critical safety incidents to the California Office of Emergency Services within 15 days and provides whistleblower protections for employees who raise concerns about unsafe AI deployments. Violations of the bill could result in financial penalties of up to $1 million.

The bill’s emphasis on transparency is critical as it seeks to hold companies accountable for their AI safety commitments. According to Thomas Woodside, co-founder of the Secure AI Project, “The science of how to make AI safe is rapidly evolving…This light touch policy prevents backsliding on commitments and encourages a race to the top rather than a race to the bottom.”

SB 53 also allows the California Attorney General to update the definition of a large developer post-2027, reflecting advancements in AI technology. Proponents of the bill express optimism regarding its prospects for becoming law, especially in light of Newsom’s recent initiatives focused on AI safety.

However, the bill has faced significant opposition from industry groups who argue that the compliance costs would be burdensome and unnecessary, as AI companies are already incentivized to avoid catastrophic harms. OpenAI has actively lobbied against the legislation, while the technology trade organization Chamber of Progress contends that it would stifle innovation by imposing excessive paperwork requirements.

Critics, such as Neil Chilson from the Abundance Institute, warn that the bill could lead to a cumbersome regulatory framework. In contrast, supporters like Anthropic assert that thoughtful governance of AI is essential and that SB 53 provides a proactive path forward.

The debate surrounding SB 53 reflects broader discussions about the appropriate level of government involvement in AI regulation. While some advocate for a unified federal approach, the reality is that most AI companies are based in California, making the state’s legislation particularly influential.

As the conversation continues, the underlying question remains: how do we define catastrophic risks in the context of AI? The bill initially set the threshold for catastrophic risk at 100 casualties before it was amended to 50, highlighting the complexities involved in establishing clear definitions. While the bill targets significant threats, many existing issues—such as the potential for AI to exacerbate societal inequalities—remain outside its scope.

Ultimately, SB 53’s focus on transparency and accountability may help mitigate the risks associated with advanced AI.
